1. Acceptance

By creating an account or using RevealyAI ("Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms constitute a legally binding agreement between you and RevealyAI, and incorporate our Privacy Policy.

2. Description of the Service

RevealyAI is an AI-powered market validation platform that helps users identify target market sectors, generate prospect lists, send personalized outreach via email and LinkedIn, discover relevant online communities, and run surveys and interviews. The Service is intended for professional use only: it is offered to businesses and to individuals acting in the course of their trade, business or profession, and not to consumers.

3. Accounts

You must be at least 18 years old to create an account.
You are responsible for maintaining the confidentiality of your credentials.
You must provide accurate information during registration.
One person or legal entity may not maintain more than one free trial account.

4. Subscriptions, wallet & billing

RevealyAI Access is a monthly subscription that unlocks the product and includes a monthly credit allowance. LinkedIn outreach is an optional add-on billed per connected account. Current prices are shown on our pricing page and form part of these Terms.
New accounts receive a 5-day free trial. A payment card is required at signup and you are automatically charged when the trial ends unless you cancel before then.
Subscriptions renew automatically unless cancelled before the renewal date.
Beyond the subscription, usage is funded by a prepaid credit wallet. Wallet balances are denominated in euros, are credited on purchase, and never expire while your subscription remains active. The monthly allowance resets each billing cycle and does not roll over.
You can cancel at any time from your account settings. Cancelling stops new spending immediately and starts a 7-day grace period during which your data stays readable and exportable. After 7 days without reactivation, account data is permanently deleted.
All payments are processed by Stripe. Prices are listed in euros and exclude applicable taxes.
We reserve the right to change pricing with 30 days notice. Wallet credit already purchased is unaffected.

5. Guaranteed responses and guaranteed interviews

Some wallet items are sold as "guaranteed". This means the following, and nothing more:

A guaranteed survey response is one completed response from a participant recruited through Prolific, meeting the screening criteria you configured.
A guaranteed interview is one scheduled and completed live interview session with a participant recruited through Prolific, meeting the screening criteria you configured.
We guarantee delivery of the session or response, not its content, quality, usefulness, or any particular conclusion. Participants answer honestly and independently; we do not influence what they say.
If a guaranteed item cannot be delivered (for example because no participant matches your screening criteria, or a participant fails to attend and cannot be replaced), the corresponding credits are returned to your wallet in full. This is your sole and exclusive remedy for non-delivery.
Delivery times depend on panel availability and are estimates, not commitments.

6. Refunds

Swiss law provides no general right of withdrawal for contracts concluded at a distance. In addition, because the Service is supplied to professionals acting in the course of their business, the 14-day right of withdrawal that EU law grants to consumers does not apply either.

Subscription payments and wallet top-ups are non-refundable except where required by applicable law, or as expressly provided in section 5 for undelivered guaranteed items. If you believe you were charged in error, contact us within 14 days at info@revealyai.com and we will investigate in good faith.

7. Acceptable Use

You agree not to use RevealyAI to:

Send spam or unsolicited bulk messages in violation of applicable law, including art. 3(1)(o) of the Swiss Unfair Competition Act (UCA/UWG), the GDPR and ePrivacy Directive, CAN-SPAM and CASL.
Contact individuals who have objected to being contacted, or continue outreach after an opt-out request.
Impersonate another person or entity, or misrepresent your affiliation.
Scrape, reverse-engineer, or abuse the platform, or circumvent quotas and rate limits.
Use the Service for any illegal purpose, or to process special categories of personal data.
Violate LinkedIn's, Google's, Microsoft's, Reddit's or Prolific's terms of service through the integrations.

You are solely responsible for the content of every message sent through RevealyAI, for having a lawful basis to contact each recipient, and for compliance with applicable outreach and data protection law in your jurisdiction and in the recipient's. We may investigate suspected violations and suspend accounts that breach this section.

8. Data protection roles

RevealyAI is established in Switzerland and processes personal data under the Swiss Federal Act on Data Protection (revFADP) and, where applicable, the GDPR. For the personal data you enter and the outreach you choose to send, you act as data controller and RevealyAI acts as your processor, processing that data on your documented instructions. A Data Processing Agreement incorporating the Standard Contractual Clauses, with the Swiss adaptations, is available on request at info@revealyai.com. Our Privacy Policy lists our sub-processors and describes how prospect and interview data is handled.

9. Your content and AI-generated output

You retain ownership of the content you input into the platform. You grant RevealyAI a limited, non-exclusive licence to process that content solely to provide the Service. We do not use your content to train AI models.

You own the output generated for you (sector analyses, contact lists, drafted messages, survey and interview summaries) and may use it for any lawful purpose, including commercially. RevealyAI and its original content, features, and functionality remain owned by RevealyAI and protected by intellectual property laws.

10. AI disclaimer

Output is produced by probabilistic AI models. It may contain inaccuracies, outdated information, mismatched or non-existent contacts, hallucinated details, and misjudged tone. You must review AI-generated content before you rely on it or send it.

RevealyAI is a research and outreach tool, not a source of factual truth and not a substitute for professional, legal or commercial judgement. We are not liable for decisions you make on the basis of AI output, nor for messages you choose to send. Content is processed by third-party AI providers, including OpenAI, whose terms also apply to that processing.

11. Third-party integrations and availability

RevealyAI integrates with Google (Gmail), Microsoft (Outlook), LinkedIn (via Unipile), Reddit, Daily.co, Prolific and Stripe. Use of these integrations is also subject to the respective third-party terms. RevealyAI is not responsible for changes, restrictions or interruptions to third-party services, including a provider revoking API access.

We aim to keep the Service available continuously but do not offer a contractual uptime commitment. We may perform maintenance, and may modify, suspend or discontinue features with reasonable notice where practicable.

12. Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis, without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, title, and non-infringement. RevealyAI does not warrant that the Service will be uninterrupted, error-free, or secure, that contact data will be accurate or current, that outreach will receive replies, or that AI-generated output will be accurate, appropriate, or free of infringing content.

13. Limitation of Liability

To the maximum extent permitted by law, RevealyAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, business, goodwill or data, arising from your use of the Service.

Our total liability for any claim arising under these Terms shall not exceed the amount you paid us in the 3 months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those jurisdictions, our liability is limited to the maximum extent permitted by law, and the above limitations may not apply to you.

14. Indemnity

You agree to indemnify and hold harmless RevealyAI, its officers and contractors from and against any claims, damages, liabilities, penalties and expenses (including reasonable legal fees) arising from or related to:

the content of messages you send through the Service;
your outreach practices, including any claim by a recipient or a data protection authority;
your use of generated output;
your breach of these Terms or of section 7 in particular;
your violation of any third-party right or applicable law.

15. Termination

We may suspend or terminate your account immediately if you breach these Terms or if we are required to do so by law. Upon termination, your right to use the Service ceases immediately and the data retention rules in section 4 apply. Sections 9 through 14, 16 and 17 survive termination.

16. Governing Law

These Terms are governed by Swiss law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts at RevealyAI's registered seat in Switzerland.

Mandatory consumer protection provisions of the country where a user is habitually resident remain unaffected where they apply.

17. General

Force majeure: neither party is liable for failure to perform due to events beyond its reasonable control, including outages of third-party providers.
Severability: if a provision is held unenforceable, the remainder stays in force.
Assignment: you may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
Entire agreement: these Terms and the Privacy Policy constitute the entire agreement between you and RevealyAI regarding the Service.
No waiver: failure to enforce a provision is not a waiver of it.

18. Changes to Terms

We may update these Terms at any time. We will notify you by email or in-app notice at least 14 days before material changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
